Article 1 - Definitions
In these terms and conditions, the following definitions shall apply:
1. Reflection period: the period within which the consumer can make use of his right of withdrawal;
2. Consumer: the natural person who enters into an (electronic) distance contract with us, Westlandpeppers;
3. Day: calendar day;
4. Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
5. Durable medium: any means that enables the consumer or entrepreneur to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.
6. Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
7. Entrepreneur/Westlandpeppers: the natural or legal person offering products and/or services to consumers at a distance;
8. Distance contract: an agreement whereby, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;
9. Technique for distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having come together in the same room at the same time;
10. General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 - Applicability
1. These general conditions apply to every offer of Westlandpeppers and to every distance contract and order concluded between Westlandpeppers and the consumer.
2. Before the distance contract is concluded, the text of these general conditions will be made available to the consumer. If this is not reasonably possible, before the distance agreement is concluded, it will be indicated that the general terms and conditions can be inspected at Westlandpeppers and they will be sent free of charge to the consumer at his request as soon as possible.
3. If the distance contract is concluded electronically, notwithstanding the preceding paragraph and before the distance contract is concluded, the text of these general conditions may be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be read electronically and that at the consumer's request they will be sent electronically or otherwise free of charge.
4. In the event that specific product conditions apply in addition to these general conditions, the second and third paragraphs shall apply mutatis mutandis and, in the event of conflicting general conditions, the consumer may always rely on the applicable provision that is most favorable to him.
5. If one or more provisions in these general terms and conditions are at any time wholly or partially void or annulled, the agreement and these terms and conditions shall otherwise remain in force and the provision in question shall be replaced without delay in mutual consultation by a provision that approximates the purport of the original to the greatest extent possible.
6. Situations not regulated in these general terms and conditions should be assessed 'in the spirit' of these general terms and conditions.
7. Uncertainties about the interpretation or content of one or more provisions of our terms and conditions must be interpreted 'in the spirit' of these general terms and conditions.

Article 4 – Our Offer
1. Our products are mostly fresh natural products, and they all have a certain shelf life. Check out the product specifications and/or FAQ page for more info.
2. Our offers are non-binding. We can change and adjust them anytime. Special offers are valid only while supplies last.
3. Our offers include a full description of the products. The description is detailed enough for you to properly assess what we're offering. We use truthful images so you get a good idea of the products. Obvious mistakes or errors won't hold us to anything.
4. All images and specifications in our offers are just indications and can't be a reason for compensation or dissolving the agreement.
5. Product images accurately show what we're offering. However, we can't guarantee that the colors/sizes displayed will exactly match the real colors/sizes of the products.
6. Every offer includes enough info so you clearly understand your rights and obligations when accepting it. This includes, in particular:
• the price, including taxes;
• shipping costs;
• how the agreement will be made and what steps are needed;
• whether the right of withdrawal applies;
• how payment, delivery, and agreement execution will happen;
• the period for accepting the offer, or the period during which we guarantee the price;
• how you can check and correct any data you've provided for the agreement before it's finalized, if you want to;
• any other languages, besides Dutch, in which the agreement can be made;
• How you choose a specific type and/or color of the item.

Article 5 – The Agreement
1. An agreement with Westlandpeppers is made when the consumer places an order on the shop.westlandpeppers.com website and receives an electronic order confirmation. An agreement with Westlandpeppers can also be made via email or phone.
2. Once the consumer accepts the offer electronically or by phone, we'll confirm receipt of the order via an electronic order confirmation. As long as we haven't confirmed this acceptance, both the consumer and we can cancel the agreement. You can only cancel the agreement by emailing Westlandpeppersinfo@gmail.com.
3. We take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe web environment. If the consumer pays electronically, we'll implement suitable security measures for that.
4. The consumer can read/find the following information in the product specifications, General Terms and Conditions, or on the FAQ page:
a. our visiting address where consumers can submit complaints;
b. the conditions and methods for consumers to exercise their right of withdrawal, or a clear notice regarding the exclusion of the right of withdrawal, see Article 6;
c. information about warranties and existing after-sales service, see Article 9;
d. the details mentioned in Article 4, paragraph 3 of these terms, unless we've already provided this information to the consumer before the agreement was executed;
5. Every agreement is entered into under the condition of sufficient availability of the relevant products.
6. Westlandpeppers reserves the right to refuse orders or find an alternative solution when:
a. products on the site are clearly mispriced due to typos or similar errors, see Article 8, paragraph 3.
b. ordered products are temporarily or permanently unavailable.
c. the stock of products with a special offer has run out.
d. provided contact and delivery details, such as phone numbers, email address, or delivery address, turn out to be incorrect.
7. If we don't accept the agreement or want to offer an alternative solution, we'll get back to you within 48 hours (excluding weekend orders), see Article 10, paragraph 8.
8. Westlandpeppers' administration serves as proof of orders placed, payments made, and deliveries carried out by the customer to Westlandpeppers. Westlandpeppers acknowledges that electronic communication serves as proof. By accepting these terms, the consumer also acknowledges this.

Article 6 – Right of Withdrawal
1. All products, except for accessories (see paragraph 2), cannot be returned. Due to the nature of the products, it's not safe for food safety and hygiene to send them back, as they are (fresh) food items. If the consumer isn't happy with the products received or got the wrong ones, please see paragraph 3 for further actions. Products cannot be returned if they:
a. cannot be returned due to their nature;
b. can spoil or expire quickly;
2. Products that can be returned are those listed under 'Accessories' in the webshop. These items can be returned if they haven't been used, for hygiene reasons.
3. If it's shown that the products don't match the agreement, the consumer needs to prove this with a clear photo of the damaged or incorrect items. If this happens, we'll replace the affected products entirely or partially with a new free shipment, or issue a full or partial credit.
4. If the consumer wants to use the right mentioned in paragraph 3, the customer must inform Westlandpeppers via email at Westlandpeppersinfo@gmail.com within 1 working day of receiving the product. After the consumer has indicated they wish to use paragraph 3, they must send a clear photo as mentioned in paragraph 3. The product cannot be returned due to the nature of (fresh) products (food). It is not food-safe to send the products back.
5. If the customer hasn't indicated their wish to exercise their right of withdrawal after the periods mentioned in paragraphs 3 and 4, the purchase is considered final.
6. We reserve the right to refuse compensation for damaged products based on photos or returned products if the product is demonstrably damaged by the consumer.
7. Damaged products will need to be disposed of by the consumer themselves.

Article 7 - Costs in case of withdrawal
1. If the consumer makes use of his right of withdrawal, the costs of return shipment shall be at his expense.
2. If the consumer receives part or all of the amount back, we will refund this amount as soon as possible, but at the latest within 14 days after revocation. This is subject to the condition that this is agreed upon, after receiving the photos mentioned in article 6 paragraph 3. Refund will be made through the same payment account/method used by the consumer unless the consumer explicitly gives permission for a different payment account/method.
3. If the product is damaged due to careless handling by the consumer himself, the consumer is liable for any decrease in value of the product.
4. The consumer cannot be held liable for depreciation of the product if not all legally required information about the right of withdrawal has been provided by us, this should be done before the conclusion of the purchase agreement.

Article 8 – Pricing
1. Unless we've agreed otherwise, all prices are in Euros. The prices listed in the product specifications don't include delivery/processing fees. We'll charge delivery/processing fees for your order, and you can find these fees per country on our FAQ page.
2. All prices mentioned include VAT.
3. All prices are subject to typing and printing errors. We're not responsible for the consequences of any typing or printing errors. If there are any, we're not obligated to deliver the product at the incorrect price.

Article 9 - Conformity and Guarantee
1. We guarantee that the products comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
2. A warranty period of 2 years applies to the accessories. There is no warranty period on all other products, fresh & dried, because this is food.
3. Any defective or incorrectly delivered products should be reported to us within 1 day of delivery via email Westlandpeppersinfo@gmail.com. Products must be returned in their original packaging and in new condition, see article 6 for which products can and cannot be returned.
4. The warranty period corresponds to the manufacturer's warranty period. However, we are never responsible for the ultimate suitability of the products for each individual application by the consumer, nor for any advice regarding the use or application of the products.
5. The warranty does not apply if:
- The consumer has repaired and/or modified the delivered products himself or has had them repaired and/or modified by third parties;
- The delivered products have been exposed to abnormal conditions or otherwise carelessly treated or have been treated contrary to our instructions or on the packaging;
- The inadequacy is wholly or partially the result of regulations that the government has set or will set regarding the nature or quality of the materials used.

Article 10 – Delivery and Execution
1. Westlandpeppers will take the utmost care when receiving and fulfilling your order. Any special requests should be noted by the consumer in the 'Comments' section of the order screen. Here, the consumer can add information and/or remarks about their order.
2. The delivery address will be the one the consumer provided to the company when filling in their details. The consumer is responsible for the accuracy and completeness of their contract and delivery information.
3. Once an order is complete, Westlandpeppers hands it over to our parcel service, DHL. DHL will send the consumer a message with a tracking code so you can follow your delivery. You can also request a tracking code from us. DHL is responsible for delivering orders, so we're not liable for late deliveries. If there are any issues, the consumer can contact us, and we'll look into a solution.
4. Westlandpeppers isn't responsible for consumer email settings that mark emails from DHL and Westlandpeppers as spam.
5. Keeping in mind what's stated in paragraph 6 of this article, Westlandpeppers will fulfill accepted orders promptly, but no later than 14 days, unless the consumer has agreed to a longer delivery period. If delivery is delayed, or if an order cannot be fulfilled, or only partially, the consumer will be notified no later than 7 days after placing the order. In such a case, the consumer has the right to cancel the agreement without any costs. The consumer is not entitled to compensation for damages.
6. All delivery times are estimates. The consumer cannot derive any rights from any stated deadlines. Exceeding a deadline does not entitle the consumer to compensation for damages.
7. If the agreement is canceled according to paragraph 5 of this article, Westlandpeppers will refund the amount paid by the consumer as quickly as possible, but no later than 14 days after cancellation.
8. If Westlandpeppers can't deliver part of an order, for example, because the product hasn't been harvested or supplied yet, we'll get in touch with the consumer. In that case, the consumer can choose to cancel the order, or receive a delivery without the missing products. The consumer can also opt to have these delivered later in a second shipment, free of charge. If the order is canceled, Westlandpeppers will refund the invoice value to the consumer within one week. This always happens in consultation with and only with the approval of the consumer.
9. The risk of damage and/or loss of products rests with Westlandpeppers until the moment of delivery to the consumer or a pre-designated representative known to Westlandpeppers, unless explicitly agreed otherwise.

Article 11 – Payment
1. Payment must be completed immediately after placing your order via the website. You can choose to pay via iDEAL, PayPal, Sofort, MisterCash, or a bank transfer. Order processing begins once payment is received. We don't ship orders without payment.
2. If you choose to pay via bank transfer, please transfer the relevant amount directly to our bank account. Kindly use your order number as the payment reference. For this payment option, we charge a €2.95 administration fee. Your order will only be processed once we've received your payment.
3. The consumer is obliged to report any inaccuracies in provided or stated payment details to us immediately.
4. In case of non-payment by the consumer, Westlandpeppers reserves the right, subject to legal limitations, to charge reasonable costs communicated to the consumer beforehand.

Article 12 – Complaints Procedure
1. If you have a complaint about our agreement, please send a full and clear description to us at Westlandpeppersinfo@gmail.com within 7 days of noticing the issue.
2. We'll get back to you about your complaint within 3 days of receiving it. If we expect it to take a bit longer to resolve, Westlandpeppers will send you an acknowledgment within 14 days, letting you know when you can expect a more detailed response.
3. If we can't sort out the complaint together, it becomes a dispute that falls under our dispute resolution process.
4. Making a complaint doesn't stop Westlandpeppers' obligations, unless Westlandpeppers tells you otherwise in writing.
5. If Westlandpeppers finds your complaint valid, we'll replace the products for free or credit you the amount.

Article 13 – Disputes
1. Any agreements between Westlandpeppers and you, our customer, that these terms and conditions cover, are exclusively governed by Dutch law. This applies even if you live abroad.
2. The Vienna Sales Convention doesn't apply here.
3. If a dispute comes up with a customer, Westlandpeppers will always try our best to resolve it fairly and amicably together.

Article 14 - Additional or different provisions
- Westlandpeppers can in no case be held liable for consequences which can or have been caused directly or indirectly by publication of the data displayed on the website and any affiliated websites, as well as for damage which has been or threatens to be inflicted and arises from or is in any way related to the use of the (publications on this) web page or with the impossibility to consult the web page. Also for misunderstanding, delays or not properly communicated orders and messages resulting from the use of Internet or any other communication between the consumer and Westlandpeppers, Westlandpeppers can not be held liable.
- This provision does not apply if it can be proven that this was intentional or due to obvious negligence of Westlandpeppers .
- The information on the site is regularly updated and / or modified. Westlandpeppers reserves the right to make any changes with immediate effect and without notice. Also, Westlandpeppers reserves the right to modify the general terms and conditions and privacy statement.

Product Ratings/Reviews
– Just so you know, the product ratings/reviews written by customers are their personal opinions. Westlandpeppers doesn't automatically endorse or take responsibility for the content of these posts. Westlandpeppers does reserve the right to remove any text that's irrelevant, offensive, or discriminatory from the website.
– While Westlandpeppers does everything we can to prevent misuse, Westlandpeppers isn't responsible for any information, reviews, or messages posted by users on the website.

Incorrect Information
– We've gathered all the info on our website to the best of our knowledge and belief, but sometimes there might be inaccuracies or things presented incorrectly. If you notice any clear differences between the website's info and your experience, we'd really appreciate it if you could let us know, even though you can't claim any rights based on the website's information.
– You can't claim any rights based on incorrect prices or images. Sometimes an image might not match a product, or a product might show a different (old or new) packaging. Westlandpeppers isn't liable for these instances either.

Medical Liability
– Westlandpeppers isn't responsible in any way for medical issues that might come from using our products with medication or if you have allergies. It's up to you to pay attention to product information that's important for your health. Some of the peppers/sauces Westlandpeppers sells are extremely hot, so please handle and eat them carefully!

External (Hyper)links
Any (hyper)links, especially in our weblog (westlandpeppers.blogspot.nl) and other sites/social media like our Facebook page, might take you to websites outside of Westlandpeppers' domain. These aren't owned by Westlandpeppers, but are just there for extra info for our visitors. If you click on these links, you'll be leaving Westlandpeppers' website/blog/social media. We do our best to carefully select the websites we link to. However, we can't guarantee the content or functionality of third-party websites. So, we disclaim any liability for the content of websites not maintained by Westlandpeppers.

At Westlandpeppers, we really care about your privacy. That's why we only process data we need to provide (and improve) our services, and we handle the information we collect about you and your use of our services with great care. This privacy policy applies to your use of the Westlandpeppers webshop and the services available through it. These terms became effective on 30-06-2022, and publishing a new version will invalidate all previous versions. About data processing

Below, you can read how we process your data, where we store it (or have it stored), what security techniques we use, and who can access your data.

Webshop Software 

WooCommerce
Our webshop is built using WooCommerce software, and we've chosen Buro Staal for our web hosting. Any personal data you provide for our services is shared with them. Buro Staal can access your data to provide us with (technical) support, but they'll never use your data for any other purpose. Based on our agreement with them, Buro Staal is required to take appropriate security measures. These measures include SSL encryption and a strong password policy. We also make regular backups to prevent data loss.

Web Hosting 

Buro Staal
We use Buro Staal for our web hosting and email services. Buro Staal processes personal data on our behalf and doesn't use your data for their own purposes. However, they might collect metadata about how the services are used, but this isn't personal data. Buro Staal has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Buro Staal is bound by a confidentiality agreement.

Email and Mailing Lists 

Zoho Campaigns
We send our email newsletters using Zoho Campaigns. Zoho Campaigns will never use your name and email address for their own purposes. At the bottom of every automated email sent via our website, you'll see an 'unsubscribe' link. If you click it, you won't receive our newsletter anymore. Your personal data is securely stored by Zoho Campaigns. Zoho Campaigns uses cookies and other internet technologies to track if emails are opened and read. Zoho Campaigns reserves the right to use your data to further improve their services and, in that context, share information with third parties.

Gmail
For our regular business email, we use Gmail's services. They've taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Gmail doesn't have access to our inbox, and we treat all our email correspondence confidentially.

SurveyMonkey
We use SurveyMonkey's services to send out surveys. SurveyMonkey will never use your name and email address for their own purposes. They've taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Survey results are processed anonymously, and we can't see who filled out which survey. This means all information (names, email addresses, IP addresses, and custom respondent data) is excluded from the survey results.

Payment Processors 

Mollie
To handle some or all payments in our webshop, we use Mollie's platform. Mollie processes your name, address, and residence details, as well as your payment info like your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve their services and, in that context, share (anonymized) data with third parties. All the safeguards mentioned above for protecting your personal data also apply to parts of Mollie's services where they involve third parties. Mollie doesn't store your data longer than legally allowed.

Shipping and Logistics 

DHL
When you place an order with us, it's our job to get your package delivered to you. We use DHL's services for deliveries. For this, we need to share your name, address, and residence details with DHL. DHL only uses this data to fulfill the agreement. If DHL uses subcontractors, they'll also make your data available to those parties.

Invoicing and Accounting 

Exact Software
For our administration and accounting, we use Exact Software's services. We share your name, address, residence details, and order specifics. This data is used for managing sales invoices. Your personal data is securely sent and stored. Exact Software is bound by confidentiality and will treat your data confidentially. Exact Software doesn't use your personal data for any purposes other than those described above.

Purpose of Data Processing

General Purpose of Processing 

We only use your data for our services. This means the purpose of processing is always directly related to the task you've given us. We don't use your data for (targeted) marketing. If you share data with us and we use it to contact you later – other than at your request – we'll explicitly ask for your permission first. Your data isn't shared with third parties, except to meet accounting and other administrative obligations. All these third parties are bound by confidentiality due to their agreement with us, an oath, or a legal obligation.

Automatically Collected Data 

We use data automatically collected by our website to make our services even better for you. Don't worry, this info (like your IP address, browser, and operating system) isn't personal data.

Helping out with tax and criminal investigations

In certain situations, Westlandpeppers might be legally obligated to share your data due to government tax or criminal investigations. If that happens, we'll be forced to share your data, but we'll resist it as much as the law allows us.

How long we keep your info 

We hold onto your info for as long as you're a customer with us. So, we'll keep your customer profile until you tell us you don't want to use our services anymore. If you do, we'll treat that as a 'forget me' request. Just so you know, we do have to keep invoices with your (personal) data for a certain period due to legal requirements. But don't worry, our team won't have access to your customer profile or any documents we created for your orders after that.

Your Rights 

Under Dutch and European law, you have certain rights when it comes to your personal data that we handle. We'll explain those rights below and how you can use them. To keep things safe and prevent misuse, we usually send copies of your data only to the email address we already have for you. If you'd like to get your data sent to a different email or even by mail, we'll just need you to confirm your identity. We keep track of all requests we handle, and for 'forget me' requests, we'll anonymize your data. You'll get all copies of your data in a machine-readable format that our systems use. And remember, you can always file a complaint with the Dutch Data Protection Authority if you think we're not handling your personal data correctly.

Your Right to See Your Data 

You always have the right to view any data we process (or have processed) that relates to you or can be traced back to you. You can make such a request by emailing Westlandpeppersinfo@gmail.com. You'll get a response to your request within 30 days. If your request is approved, we'll send a copy of all your data to the email address we have on file, along with an overview of the processors holding this data and the category under which we've stored it.

Right to Correct Your Data

You always have the right to have any data we process (or have processed) that relates to you or can be traced back to you, adjusted. You can make such a request by emailing Westlandpeppersinfo@gmail.com. You'll get a response to your request within 30 days. If your request is approved, we'll send a confirmation to the email address we have on file, letting you know your data has been updated.

Right to Limit Data Processing 

You always have the right to limit the processing of any data we handle (or have handled) that relates to you or can be traced back to you. You can make such a request by emailing Westlandpeppersinfo@gmail.com. You'll get a response to your request within 30 days. If your request is approved, we'll send a confirmation to the email address we have on file, letting you know that your data will no longer be processed until you lift the restriction.

Right to Data Portability 

You always have the right to have your data that we process (or have processed for us) transferred to another party. Just send a request to our privacy contact person, and we'll get back to you within 30 days. If we approve your request, we'll send copies of all your data that we or our partners have processed to the email address we have on file for you. Keep in mind, if you choose to do this, we probably won't be able to continue our services because we can't guarantee the secure connection of data files anymore.

Right to Object and Other Rights 

In certain cases, you have the right to object to Westlandpeppers processing your personal data, whether directly or on our behalf. If you object, we'll immediately stop processing your data while we handle your objection. If your objection is valid, we'll provide you with copies of the data we process (or have processed) and then permanently stop processing it. You also have the right not to be subjected to automated individual decision-making or profiling. We don't process your data in a way that this right would apply. Cookies 

We use cookies on our websites. What are cookies? They're just small, simple text files with data that either get saved on your computer's hard drive or stay in your browser's session. Some cookies are super important for our website to work smoothly. We use them to remember your preferences – for example, they help us recognize you after you've logged in so you don't have to type your password every time you visit. These cookies also remember items you've popped into your shopping cart in our webshop, even if you close the site and come back later. And yep, they remember your language preference too!

Social Media

We use social media functionality to easily share pages. This uses functionality from Facebook, Twitter and Pinterest. Westlandpeppers has no control over the cookies they place.

Google Analytics 

We use cookies from the American company Google on our website as part of their 'Analytics' service. This helps us keep track of how visitors use our site and get reports on it. Google might have to share this data based on current laws and regulations. We gather info about your browsing habits and share it with Google. Google can then combine this info with other data to track your online activity. They use this to show you things like targeted ads (Adwords) and other Google services and products.

Third-Party Cookies 

If any third-party software we use also uses cookies, we'll mention it in this privacy statement.

Changes to Our Privacy Policy 

We can change our privacy policy whenever we need to, but you'll always find the latest version right here on this page. If any changes affect how we handle your data that we've already collected, we'll be sure to let you know by email.
