Article 1 - Definitions
In these terms and conditions, the following definitions shall apply:
1. Reflection period: the period within which the consumer can make use of his right of withdrawal;
2. Consumer: the natural person who enters into an (electronic) distance contract with us, Westlandpeppers;
3. Day: calendar day;
4. Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
5. Durable medium: any means that enables the consumer or entrepreneur to store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.
6. Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
7. Entrepreneur/Westlandpeppers: the natural or legal person offering products and/or services to consumers at a distance;
8. Distance contract: an agreement whereby, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication;
9. Technique for distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having come together in the same room at the same time;
10. General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 - Applicability
1. These general conditions apply to every offer of Westlandpeppers and to every distance contract and order concluded between Westlandpeppers and the consumer.
2. Before the distance contract is concluded, the text of these general conditions will be made available to the consumer. If this is not reasonably possible, before the distance agreement is concluded, it will be indicated that the general terms and conditions can be inspected at Westlandpeppers and they will be sent free of charge to the consumer at his request as soon as possible.
3. If the distance contract is concluded electronically, notwithstanding the preceding paragraph and before the distance contract is concluded, the text of these general conditions may be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be read electronically and that at the consumer's request they will be sent electronically or otherwise free of charge.
4. In the event that specific product conditions apply in addition to these general conditions, the second and third paragraphs shall apply mutatis mutandis and, in the event of conflicting general conditions, the consumer may always rely on the applicable provision that is most favorable to him.
5. If one or more provisions in these general terms and conditions are at any time wholly or partially void or annulled, the agreement and these terms and conditions shall otherwise remain in force and the provision in question shall be replaced without delay in mutual consultation by a provision that approximates the purport of the original to the greatest extent possible.
6. Situations not regulated in these general terms and conditions should be assessed 'in the spirit' of these general terms and conditions.
7. Uncertainties about the interpretation or content of one or more provisions of our terms and conditions must be interpreted 'in the spirit' of these general terms and conditions.

Article 4 - The offer
1. The offer consists mainly of (fresh) natural products and this all has a certain shelf life, see product specification and/or FAQ page for this information.
2. The offer is without obligation. We are entitled to change and adjust the offer. Offers are valid as long as stocks last.
3. The offer contains a complete description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. We use truthful images, which give the consumer a good view of the products. Obvious mistakes or obvious errors do not bind us.
4. All images, specification data in the offer are indications and can not give rise to compensation or dissolution of the agreement.
5. Images of products are a true representation of the products offered. We cannot guarantee that the colors/sizes shown correspond exactly to the real colors/sizes of the products.
6. Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer. This concerns in particular
:
- the price including taxes;
- the costs of shipment;
- the way in which the agreement will be concluded and which actions are necessary for that;
- whether or not the right of withdrawal applies;
- the method of payment, delivery and performance of the agreement;
- the period for acceptance of the offer, or the period within which we guarantee the price;
- the manner in which the consumer, before the conclusion of the agreement, can check and, if desired, repair the data provided by him in the context of the agreement;
- the possible other languages in which, in addition to Dutch, the agreement can be concluded;
- the manner in which the consumer chooses a particular type and/or color of the article.
- This information can all be found by the consumer at the product specifications and/or FAQ page.

Article 5 - The agreement
1. The agreement with Westlandpeppers is established when the consumer has placed his order on the website of shop.westlandpeppers.com and has received the electronic order confirmation. An agreement with Westlandpeppers can also be established via e-mail or by telephone.
2. The consumer has accepted the offer electronically or by telephone, we confirm receipt of the order electronically by means of an order confirmation. As long as the receipt of this acceptance has not been confirmed by us, the consumer and we can dissolve the agreement. Dissolution of the agreement can only by e-mail Westlandpeppersinfo@gmail.com.
3. We take appropriate technical and organizational measures to protect the electronic transmission of data and ensure a secure web environment. If the consumer pays electronically, we will observe appropriate security measures for this purpose.
4. The consumer can read/find the following information with the product specification, General Terms and Conditions or on the FAQ page:
a. our visiting address where the consumer can go with complaints;
b. the conditions under which and the way in which the consumer can make use of the right of withdrawal, or a clear notification regarding the exclusion of the right of withdrawal, see article 6;
c. the information about guarantees and existing service after purchase, see article 9;
d. the information included in article 4 paragraph 3 of these terms and conditions, unless we have already provided this information to the consumer before the execution of the agreement;
5. Every agreement is entered into under the suspensive conditions of sufficient availability of the relevant products.
6. Westlandpeppers reserves the right to refuse orders or come to an alternative solution, if;
a. products on the site are obviously wrongly priced as a result of typing errors and the like, see article 8 paragraph 3.
b. ordered products are temporarily or permanently no longer available.
c. the stock of products with a special offer is exhausted.
d. specified contact and delivery details, such as telephone numbers, or e-mail address or delivery address, turn out not to be correct.
7. If we do not accept the agreement or wish to offer another solution, we will respond within 48 hours (excluding weekend orders), see article 10 paragraph 8.
8. The administration of Westlandpeppers serves as proof of the orders given by the customer to Westlandpeppers , payments made and deliveries made. Westlandpeppers acknowledges that electronic communication serves as proof. By accepting these terms and conditions, the consumer also acknowledges this.

Article 6 - Right of withdrawal
1. All products, except accessories see paragraph 2, cannot be returned. Given the nature of the products, it is not responsible for food safety and hygiene to return the products. This is because the products are (fresh) food. If the consumer is not satisfied with the products received or has received the wrong products, see paragraph 3 for further actions. Exclusion from returning products occurs because the products:
a. cannot be returned due to their nature;
b. may spoil or age quickly;
2. Products that can be returned are the products listed in the online store under the heading Accessories. These products can be returned if the products have not been used, due to the hygiene of the products.
3. If it is proven that the products do not correspond to the agreement, this must be demonstrated by the consumer with a good photo of the damaged or wrong products. If this is the case, we will replace all or part of the products in question by means of a new free shipment or a full or partial credit.
4. If the consumer wishes to exercise the right mentioned in paragraph 3, the customer must make this known within 1 working day, after receiving the product, to the Westlandpeppers via e-mail Westlandpeppersinfo@gmail.com. After the consumer has expressed his wish to make use of paragraph 3, the consumer must send a clear photo of the product as mentioned in paragraph 3. The product cannot be returned, given the nature of the (fresh) products (food). It is not food safe to return the products.
5. If the customer has not expressed his wish to use his right of withdrawal after the expiration of the periods mentioned in paragraphs 3 and 4, the sale is a fact.
6. We reserve the right to refuse reimbursement for damaged products based on photos or returned products, when the product has been demonstrably damaged by the consumer.
7. Damaged products will have to be disposed of by the consumer himself.

Article 7 - Costs in case of withdrawal
1. If the consumer makes use of his right of withdrawal, the costs of return shipment shall be at his expense.
2. If the consumer receives part or all of the amount back, we will refund this amount as soon as possible, but at the latest within 14 days after revocation. This is subject to the condition that this is agreed upon, after receiving the photos mentioned in article 6 paragraph 3. Refund will be made through the same payment account/method used by the consumer unless the consumer explicitly gives permission for a different payment account/method.
3. If the product is damaged due to careless handling by the consumer himself, the consumer is liable for any decrease in value of the product.
4. The consumer cannot be held liable for depreciation of the product if not all legally required information about the right of withdrawal has been provided by us, this should be done before the conclusion of the purchase agreement.

Article 8 - The Price
1. All prices are, unless otherwise agreed, based on payment in Euros. The prices mentioned in the product specifications do not include delivery/processing costs. For the delivery of your order, delivery/processing costs will be charged. These delivery/processing costs are described per country on the FAQ page.
2. All prices quoted include VAT.
3. All prices are subject to type and printing errors. No liability is accepted for the consequences of typing and typesetting errors. In case of type and typesetting errors we are not obliged to deliver the product according to the incorrect price.

Article 9 - Conformity and Guarantee
1. We guarantee that the products comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement.
2. A warranty period of 2 years applies to the accessories. There is no warranty period on all other products, fresh & dried, because this is food.
3. Any defective or incorrectly delivered products should be reported to us within 1 day of delivery via email Westlandpeppersinfo@gmail.com. Products must be returned in their original packaging and in new condition, see article 6 for which products can and cannot be returned.
4. The warranty period corresponds to the manufacturer's warranty period. However, we are never responsible for the ultimate suitability of the products for each individual application by the consumer, nor for any advice regarding the use or application of the products.
5. The warranty does not apply if:
- The consumer has repaired and/or modified the delivered products himself or has had them repaired and/or modified by third parties;
- The delivered products have been exposed to abnormal conditions or otherwise carelessly treated or have been treated contrary to our instructions or on the packaging;
- The inadequacy is wholly or partially the result of regulations that the government has set or will set regarding the nature or quality of the materials used.

Article 10 - Delivery and execution
1. Westlandpeppers will take the greatest possible care when receiving and executing the order. Special wishes should be specified by the consumer in the order screen at "Remarks". Here the consumer can enter information and/or comments on the order.
2. The place of delivery is the address that the consumer has made known to the company, when filling in the details. The consumer himself is responsible for the correctness and completeness of his contract and delivery details.
3. Westlandpeppers offers the order to the parcel service DHL after completion. The consumer receives notification from DHL with a track code so that the delivery can be tracked. The consumer can also request a track code through us. DHL is responsible for the delivery of the orders we are not liable for late deliveries, if there are problems the consumer can contact us, we can look for a solution.
4. Westlandpeppers is not responsible for e-mail settings of the consumer which indicate e-mails from DHL and Westlandpeppers as spam.
5. Subject to what is stated in paragraph 6 of this article, Westlandpeppers will execute accepted orders expeditiously but at the latest within 14 days, unless consumer has agreed to a longer delivery period. If the delivery is delayed, or if an order is not or only partially carried out, the consumer receives this no later than 7 days after he has placed the order message. The consumer in that case has the right to dissolve the agreement without cost. The consumer is not entitled to compensation.
6. All delivery terms are indicative. The consumer cannot derive any rights from any terms mentioned. Exceeding a term gives the consumer no right to compensation.
7. In case of dissolution in accordance with the paragraph 5 of this article Westlandpeppers will refund the amount paid by the consumer as soon as possible, but at the latest within 14 days after dissolution.
8. If Westlandpeppers cannot deliver part of an order, for example because the product has not yet been harvested or delivered, we will contact the consumer. In that case, the consumer may choose to cancel the order or receive a delivery without the products in question. The consumer can also choose to have them delivered later in a second shipment free of charge. If the order is cancelled, Westlandpeppers will refund the invoice value to the consumer within one week. This is always done in consultation and only in approval with the consumer.
9. The risk of damage and/or loss of products rests with Westlandpeppers until the moment of delivery to the consumer or a representative previously designated and made known to Westlandpeppers , unless expressly agreed otherwise.

Article 11 - Payment
1. Payment must be made immediately after completing the order via website. There is a choice of payment via I-Deal, PayPal, Sofort, MisterCash or bank transfer. Processing of the order begins upon receipt of payment. We do not ship orders without payment.
2. If chosen to pay by bank transfer, directly transfer the respective amount to our bank account. Please use the order number as payment reference. For this payment option we charge €2.95 for administration costs. The order will only be processed once we have received payment.
3. The consumer has the duty to report inaccuracies in payment details provided or mentioned to us without delay.
4. In case of non-payment by the consumer, Westlandpeppers subject to legal restrictions, has the right to charge the reasonable costs communicated in advance to the consumer.

Article 12 - Complaints procedure
1. Complaints about the execution of the agreement must be submitted within 7 days fully and clearly described to us at Westlandpeppersinfo@gmail.com, after the consumer has found the defects.
2. The complaints submitted will be answered within a period of 3 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Westlandpeppers will respond within the 14-day period with a notice of receipt and an indication of when the consumer can expect a more detailed response.
3. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.
4. A complaint does not suspend the obligations of Westlandpeppers unless Westlandpeppers indicates otherwise in writing.
5. If a complaint is found valid by Westlandpeppers, we will replace the delivered products free of charge or credit the relevant amount.

Article 13 - Disputes
1. On agreements between Westlandpeppers and the consumer to which these general conditions relate, Dutch law exclusively applies. Even if the consumer resides abroad.
2. The Vienna Sales Convention does not apply.
3. If a dispute arises with the consumer, Westlandpeppers will make every effort to resolve this in mutual consultation in reasonableness and fairness.

Article 14 - Additional or different provisions
- Westlandpeppers can in no case be held liable for consequences which can or have been caused directly or indirectly by publication of the data displayed on the website and any affiliated websites, as well as for damage which has been or threatens to be inflicted and arises from or is in any way related to the use of the (publications on this) web page or with the impossibility to consult the web page. Also for misunderstanding, delays or not properly communicated orders and messages resulting from the use of Internet or any other communication between the consumer and Westlandpeppers, Westlandpeppers can not be held liable.
- This provision does not apply if it can be proven that this was intentional or due to obvious negligence of Westlandpeppers .
- The information on the site is regularly updated and / or modified. Westlandpeppers reserves the right to make any changes with immediate effect and without notice. Also, Westlandpeppers reserves the right to modify the general terms and conditions and privacy statement.

Product reviews/reviews
- For product reviews/reviews written by consumers, this is a personal opinion of the respective writer, and therefore Westlandpeppers does not automatically endorse and is not responsible for the content of these messages. Westlandpeppers reserves the right to remove texts that are irrelevant, offensive and/or discriminatory from the website.
- Although Westlandpeppers makes every effort to prevent abuse, Westlandpeppers is not liable for information/reviews and/or messages posted by users on the website.

Erroneous information
- The information displayed on the website has been compiled to the best of our knowledge and belief but may contain inaccuracies or be incorrectly presented. Should there be any demonstrable differences between the information on the website and the consumer's experience, although no rights can be derived from the information on the website, we would greatly appreciate it if you would let us know.
- No rights can be derived from incorrect prices and images. It may happen that an image does not belong to a product or that a different, either old or new, packaging is shown. Westlandpeppers is not liable for this either.

Medical Liability
- Westlandpeppers is in no way liable for medical problems that may result from use of products in combination with medications or allergies. Consumers should be on their own alert for product information relevant to their health. Some of the peppers/sauces sold by Westlandpeppers are extremely hot and should be processed/eaten carefully.

External (hyper)links
Any (hyper)links in especially the weblog (westlandpeppers.blogspot.nl) and other sites/social media such as for example the Facebook page may lead to websites outside the domain of Westlandpeppers. These are not the property of Westlandpeppers, but are included purely for (additional) information for the visitor. If these links are activated, one leaves the website/blog/social media of Westlandpeppers. We select the websites referred to as carefully as possible. However, we cannot guarantee the content and functioning of the websi-tes of third parties. It follows that any liability for the content of websites not maintained by Westlandpeppers is rejected.

This privacy policy applies to the use of the webshop and the services accessed thereon from Westlandpeppers. The effective date for the validity of these terms is 30-06-2022, with the publication of a new version, the validity of all previous versions expires. About data processing

Below you can read how we process your data, where we store it, which security techniques we use and to whom the data can be viewed.

Web store software 

WooCommerce
Our webshop is developed with software from WooCommerce, we have chosen Buro Staal for our web hosting. Personal data you provide to us for the provision of our services will be shared with this party. Buro Staal has access to your data to provide us (technical) support, they will never use your data for any other purpose. Buro Staal is obliged under the agreement we have with them to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Regular backups are made to prevent loss of data.

Web hosting 

Buro Staal
We purchase web hosting and email services from Buro Staal. Buro Staal processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata on the use of the services. This is not personal data. Buro Staal has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Buro Staal is bound to secrecy under the agreement.

E-mail and mailing lists 

Zoho Campaigns
We send our email newsletters using Zoho Campaigns. Zoho Campaigns will never use your name and email address for its own purposes. You will see the "unsubscribe" link at the bottom of every email sent automatically through our website. You will then no longer receive our newsletter. Your personal data is stored securely by Zoho Campaigns. Zoho Campaigns uses cookies and other Internet technologies that provide insight into whether emails are opened and read. Zoho Campaigns reserves the right to use your data to further improve its services and, in this context, to share information with third parties.

Gmail
We use the services of Gmail for our regular business e-mail traffic. This party has taken appropriate technical and organizational measures to prevent abuse, loss and corruption of your and our data as much as possible. Gmail has no access to our inbox and we treat all our e-mail traffic confidentially.

SurveyMonkey
We use the services of SurveyMonkey for sending surveys. SurveyMonkey will never use your name and email address for its own purposes. This party has taken appropriate technical and organizational measures to prevent abuse, loss and corruption of your and our data as much as possible. Survey results are processed anonymously and we do not see who owns which completed survey. This means that all information (names, email addresses, IP addresses and custom data of respondents) are excluded in the survey results.

Payment processors 

Mollie
For handling (part of) the payments in our webshop we use the platform of Mollie. Mollie processes your name, address and residence details and your payment information such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and, in this context, to share (anonymized) data with third parties. All the above safeguards regarding the protection of your personal data also apply to those parts of Mollie's services for which it engages third parties. Mollie will not retain your data longer than permitted under the statutory time limits.

Shipping and logistics 

DHL
When you place an order with us, our job is to get your package delivered to you. We use the services of DHL to make the deliveries. This requires us to share your name, address and place of residence information with DHL. DHL only uses this data for the purpose of executing the contract. In the event that DHL engages subcontractors, DHL also makes your data available to these parties.

Invoicing and accounting 

Exact Software
To keep our records and accounts, we use the services of Exact Software. We share your name, address and residence information and details regarding your order. This data is used for the administration of sales invoices. Your personal data will be transmitted and stored securely. Exact Software is committed to confidentiality and will treat your data confidentially. Exact Software will not use your personal data for purposes other than those described above.

Purpose of data processing

General purpose of processing 

We use your data exclusively for the purpose of our services. That is, the purpose of processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data - other than at your request - to contact you at a later time, we will ask you explicit permission to do so. Your data will not be shared with third parties other than to meet accounting and other administrative obligations. These third parties are all bound to confidentiality by virtue of the agreement between them and us or an oath or legal obligation.

Automatically collected data 

Data that is automatically collected by our website is processed for the purpose of further improving our services. These data (for example, your IP address, web browser and operating system) are not personal data.

Cooperation in tax and criminal investigations

Where appropriate, Westlandpeppers may be required by law to share your data in connection with government tax or criminal investigations. In such a case, we are forced to share your data, but we will oppose this within the possibilities provided by law.

Retention periods 

We will retain your information for as long as you are our client. This means that we will keep your client profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret this as a request to forget. We are required by applicable administrative requirements to retain invoices containing your (personal) data, so we will retain this data for the duration of the applicable term. However, employees no longer have access to your client profile and documents we have produced as a result of your assignment.

Your rights 

Pursuant to applicable Dutch and European legislation, as a data subject you have certain rights with respect to personal data processed by us or on our behalf. We explain below which rights these are and how you can invoke these rights. In principle, to prevent misuse, we only send copies and transcripts of your data to your e-mail address already known to us. In the event that you wish to receive the data at a different e-mail address or for example by post, we will ask you to identify yourself. We keep records of processed requests, in the case of a forgetting request we administer anonymized data. You will receive all transcripts and copies of data in the machine-readable data format we use within our systems. You have the right at any time to lodge a complaint with the Personal Data Authority if you suspect that we are using your personal data incorrectly.

Right of Inspection 

You always have the right to inspect the data we process (or have processed) that relate to your person or can be traced back to you. You can make a request to that effect by emailing Westlandpeppersinfo@gmail.com. You will receive a response to your request within 30 days. If your request is granted, we will send you, at the e-mail address known to us, a copy of all data together with a list of the processors holding this data, indicating the category under which we have stored this data.

Right of Rectification

You always have the right to have the data we process (or have processed) that relates to your person or can be traced back to you amended. You can make a request to this effect by emailing Westlandpeppersinfo@gmail.com. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data have been adjusted.

Right to restriction of processing 

You always have the right to limit the data we process (or have processed) that relates to your person or is traceable to it. You can make a request to this effect by emailing Westlandpeppersinfo@gmail.com. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data will no longer be processed until you cancel the restriction.

Right to transferability 

You always have the right to have the data we process (or have processed) that relates to your person or can be traced back to you by another party. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days. If your request is granted, we will send you, at the e-mail address known to us, copies or transcripts of all data about you that we have processed or have processed on our behalf by other processors or third parties. In all likelihood, we will no longer be able to continue providing services in such a case, as the secure interconnection of data files can then no longer be guaranteed.

Right to object and other rights 

You have, in appropriate cases, the right to object to the processing of your personal data by or on behalf of Westlandpeppers. If you object, we will immediately cease processing your personal data pending the resolution of your objection. If your objection is well-founded, we will make copies and/or copies of data that we process (or have processed) available to you and then permanently stop the processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies.
